Terms & Conditions

Please read these terms carefully before booking driving lessons with DMJ Driver Training.

Eligibility

1.1Age Requirements

To undertake driving lessons, you must be aged 17 or older. If you are registered disabled, you may begin at age 16.

1.2Licence Requirements

You must hold a driving licence valid for the UK. This includes provisional, full, or appropriate foreign licences.

1.3Proof of Licence

  • You must provide proof of a valid licence before your first lesson starts.
  • If you fail to provide proof, your instructor will refuse to conduct the lesson.
  • You will still be charged the full price for that lesson.

Cancellation and Lateness Policy

2.1Notice Period

You must give at least 48 hours' notice to cancel or rearrange a lesson.

2.2Late Cancellation Fee

Failure to provide 48 hours' notice will result in the full lesson fee being charged.

2.3Unpaid Fees

If you cancel late and have not yet paid, this fee must be cleared before booking any future lessons.

2.4Instructor Waiting Time

  • Instructors will wait at your pick-up location for a maximum of 10 minutes.
  • If you do not arrive within 15 minutes, the lesson is cancelled.
  • You will be charged the full lesson fee.

2.5Student Lateness

If you are late, your lesson time will be reduced. Instructors cannot delay their next client. You will be charged the full price of the lesson.

2.6Payment

Payment for all lessons must be made at least one week in advance unless prior arrangements have been made with your instructor. Payment can be made via bank transfer, via your free app, or cash.

2.7Late Payment

Late payment may result in your lesson slot being made available to other pupils.

Instructor Autonomy, Test Readiness, and Vehicle Use

3.1Instructor Authority

All lesson structures, teaching methods, and student progressions are decided by the instructor. Assessments align with official DVSA Driving Skills Guidance. Disagreements with these professional opinions do not constitute grounds for a complaint.

3.2Prior Agreement for Test Bookings

Students must agree on test dates in advance with their instructor. Your instructor is not obliged to provide their car for a test booked without their prior approval.

3.3Test Readiness Timeline

Test readiness is officially evaluated during a mock test two lessons prior to your test date.

3.4Criteria for Vehicle Use

The instructor reserves the right to withhold their vehicle for a driving test if a student is deemed unready. To use the vehicle, you must consistently demonstrate these benchmarks:

  • 3.4.1 Independent Driving: Navigate routes safely without verbal or physical intervention.
  • 3.4.2 Fault-Free Performance: Drive consistently without committing serious or dangerous faults.
  • 3.4.3 Mock Test Success: Achieve a passing standard during formal mock tests under exam conditions.
  • 3.4.4 Emotional Control: Maintain composure and execute safe decision-making under test pressure.

3.5Mandatory Rescheduling and Deadlines

  • Students evaluated as unready will not be permitted to use the tuition vehicle.
  • To protect your test fee, reschedule at least 10 full working days (Mondays to Saturdays) before your test date.

3.6Driving Test Priority

Driving tests always take priority over normal driving lessons. If a student's test clashes with your scheduled lesson, your lesson will be rearranged.

3.7Speeding Fines and Penalties

The pupil is fully and legally responsible for complying with all speed limits and road traffic laws during the lesson. In the event of a speeding offence or traffic violation, any resulting fines, legal penalties, and penalty points will be issued directly to, and remain the sole responsibility of, the pupil's driving licence.

Complaints Procedure

4.1Step 1: Informal Resolution

If you are unhappy with your training, raise the concern directly with your instructor immediately to resolve it informally.

4.2Step 2: Formal Written Complaint

If unresolved, submit a formal written complaint within seven (7) calendar days of the issue occurring.

  • 4.2.1 Submission Channel: Complaints must be emailed to: info@dmjdriving.co.uk.
  • 4.2.2 Required Information: Include your full name, instructor's name, lesson dates, and full factual details.

4.3Step 3: Review Timeline

  • 4.3.1 Acknowledgement: DMJ Driver Training will acknowledge your complaint within five (5) working days.
  • 4.3.2 Full Response: A formal response will be provided within fourteen (14) working days.
  • 4.3.3 Investigation: We reserve the right to review lesson logs, digital records, and consult your instructor.

4.4Procedure Exclusions

  • 4.4.1 Out-of-Time: Complaints submitted after seven (7) calendar days will not be considered.
  • 4.4.2 Channels: We do not accept complaints via social media, text message, or third parties.
  • 4.4.3 Detail: We cannot investigate complaints that lack sufficient detail.

Refund Policy

5.1No-Quibble Refund Guarantee

If you choose to discontinue lessons, DMJ Driver Training will refund any remaining, unused funds left in your prepaid account.

5.2Administration Fee

All processed refunds are subject to a 20% administration charge to cover processing and operational costs.

5.3Non-Refundable Items

Refunds will strictly not be issued under any circumstances for:

  • 5.3.1 Completed driving lessons or training hours already delivered.
  • 5.3.2 Late cancellations with less than 48 hours' notice.
  • 5.3.3 Professional decisions regarding test readiness.
  • 5.3.4 Withholding the vehicle due to a student failing to meet safety standards.

Liability and Consumer Rights

6.1Liability Limitations

Your instructor and DMJ Driver Training are not liable for loss or damage where:

  • There is no breach of a legal duty owed to you.
  • The loss or damage is not a reasonably foreseeable result of a breach.
  • The loss or increase in loss results from your own breach or omission.
  • The loss results from circumstances outside our reasonable control.

6.2Business Loss Exclusion

Your instructor is not liable for business interest losses. This includes lost profits, loss of opportunity, or business interruption.

6.3Consumer Rights

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

Use of Personal Data (GDPR)

7.1Consent to Hold Data

By taking lessons with DMJ Driver Training, you automatically consent to us securely holding your personal information in line with the Data Protection Act 1998 and GDPR. This includes:

  • Name, address, contact details, and date of birth.
  • Driving licence number and driving test information.
  • Lesson progress records and payment receipts.
  • Medical conditions affecting your driving.
  • Lesson or pass photos taken with your permission.

7.2Purpose and Storage

We hold data solely to provide high-quality driving tuition. Data is stored on password-protected devices or secured within the Total Drive app, which manages bookings, progress, and payments.

7.3Data Sharing Restrictions

We will never pass your data to third parties without prior permission. If sharing is required (e.g., changing instructors or booking DVSA tests), we will inform you first and obtain consent.

7.4Dash Cam Recordings

Instructors use dash cams to record internal and external footage and audio. This protects you, the instructor, and the public. Written consent is required if footage is used for training aids.

7.5Your Rights

  • You have the right to inspect any information we hold about you.
  • You retain the right to request that we destroy your data.

7.6Data Retention Period

Upon passing or discontinuing lessons, Total Drive accounts are marked inactive and progress booklets are retained for five (5) years before permanent deletion. This fulfils tax, accounting, and record retrieval requirements.

7.7ICO Registration

DMJ Driver Training is registered with the Information Commissioner's Office (ICO) under reference ZB290573 (Mr David Jones).

External Complaints (DVSA)

8.1Internal Process Completion

If you remain dissatisfied after our final response, you may escalate your dispute to the Driver and Vehicle Standards Agency (DVSA) via the Official GOV.UK Driving Instructor Complaint Portal. The DVSA requires you to complete our internal complaints procedure first.

8.2DVSA Jurisdictional Exclusions

The DVSA has no jurisdiction over private commercial contracts. They will completely refuse to investigate disputes relating to:

  • 8.2.1 Lesson fees, billing, or refunds.
  • 8.2.2 Scheduling issues or booking time preferences.
  • 8.2.3 Instructor calendar availability.
  • 8.2.4 Instructor decisions regarding test readiness or vehicle use.
